Abstract

Forest areas have an important role in maintaining environmental balance and
supporting sustainable development. However, along with the increasing
development of tourism activities, the utilization of forest areas often causes legal
and environmental problems when it is carried out without complying with the
applicable regulations. One of these cases occurred on Awera Island, North Sipora
District, Mentawai Islands Regency, where the construction of resorts was carried
out within a production forest area without obtaining a Forest Area Borrow-to-Use
Permit from the Ministry of Environment and Forestry. This study aims to examine
the law enforcement against the construction of resorts in production forest areas
without borrow-to-use permits and to identify the factors that hinder the law
enforcement process. The research method used is empirical legal research based
on social facts obtained through interviews with related agencies and literature
study. The results of the study show that law enforcement against the construction
of resorts in production forest areas without borrow-to-use permits has not been
implemented effectively. Although some administrative permits have been obtained
from the local government, the obligation to obtain a Forest Area Borrow-to-Use Permit has not been fulfilled. In addition, the implementation of law enforcement
still faces several obstacles, including weak coordination between government institutions, limited supervision, and the lack of legal awareness among business
actors. Therefore, stronger supervision and coordination between related institutions are needed to ensure that tourism development in forest areas is carried out in accordance with forestry and environmental regulations.
