This study aims to determine the provisions governing deepfake technology and
cases, as well as the accountability of perpetrators of deepfake crimes. The legal
material collection technique was carried out using a literature study method by
collecting and analyzing primary and secondary legal sources. The research
method used is normative juridical with a statutory approach and case studies.
Based on the author's research results, it shows that although regulations such as
the Criminal Code, Law Number 44 of 2008 concerning Pornography and Law
Number 1 of 2024 concerning Information and Electronic Transactions (ITE)
regulate pornography and electronic transactions, there are no specific rules that
explicitly cover deepfake technology. Therefore, efforts are needed to strengthen
regulations and increase collaboration between the government and lawmakers to
prevent and reduce crimes through cyberspace like this. This study aims to
determine the use of artificial intelligence, namely deepfake, in the creation and
distribution of pornographic content and provide a deeper understanding of how
legal regulations in Indonesia can be applied to deal with the misuse of this
technology, as well as the extent to which existing provisions are able to ensnare
perpetrators of crimes involving deepfake technology. Pornographic deepfake
cases are common and cause significant harm to many people. Limited legal
regulation of these practices makes it difficult for law enforcement to prosecute the
perpetrators. This study is expected to provide input for strengthening the legal
framework related to AI and protecting the rights of victims.
