Abstract

This legal study focuses on analyzing the appropriateness of the Yogyakarta
City Government's decision to convert the Abu Bakar Ali parking lot into green
open space. This study aims to measure the appropriateness of this policy with
the principles of good administrative law, particularly the principles of
participation and transparency. The method used is normative legal research,
supported by field data through interviews, with a legal and conceptual
approach. The results of the study show that the policy formally has a strong
legal basis and is in line with the Principle of Public Interest, supported by the
mandate to preserve the UNESCO philosophical axis. In the study, the
implementation of this factual action is considered not to fully meet the
standards of the Principle of Participation and the Principle of Transparency
as stipulated in Law Number 30 of 2014 concerning Regional Government. The
lack of substantive involvement of parking attendants and affected traders is a
key indication of this procedural vulnerability. The implication of this policy is
the potential violation of the public's right to adequate parking facilities (Law
No. 25 of 2009) and the creation of legal uncertainty at the relocation site. Legal
protection for aggrieved parties is guaranteed by the Administrative
Government Law through the Administrative Remedies mechanism (Article 53)
and the right to Claim Compensation (Article 55) for actions that violate the
AUPB.
