Abstract

The Convention on the Rights of Persons with Disabilities (CRPD) is an
international convention that regulates the protection and fulfillment of human
rights for persons with disabilities, including the right to mental health. Indonesia
has ratified the CRPD through Law Number 19 of 2011, but its implementation still
faces various obstacles. Analyze the extent to which Indonesia has fulfilled its
obligations to provide mental health services in accordance with the principles of
the CRPD. The research method used is normative legal research with a statute
approach, through a review of relevant national regulations and international legal
instruments. The implementation of Indonesia's human rights obligations remains normative and not yet fully effective in the field. The main obstacles include budget
constraints, a lack of mental health personnel, weak coordination between
institutions, and social stigma against persons with disabilities. Policy reform and
increased state commitment are needed to ensure that mental health services in Indonesia are in line with the principles of non-discrimination and equality stipulated in the CRPD
