The legal thesis explores the process of converting land rights specifically the transition from the Right to Build to the Right of Ownership for residential houses
in Nganjuk Regency. The main focus of the discussion is how this alteration of rights is carried out, particularly the procedure for changing the Right to Build to into the
Right of Ownership in the subdistricts of Nganjuk and Loceret within Nganjuk Regency.
This legal thesis employs an empirical legal research approach that
emphasizes social realities and facts. The study relies on primary data supported
by secondary sources. A purposive sampling technique was used, considering the
broad scope of Nganjuk Regency; therefore, the research was concentrated in the
Nganjuk and Loceret subdistricts. The researchers collected qualitative data and
used inductive reasoning to draw conclusions.
Respondents who have converted their rights from Right to Build to the Right
of Ownership for residential house, most of them did so through the Notary & PPAT
service. In addition, respondents who had completed the conversion process noted
several benefits of changing their land rights from Right to Build to Right for
Ownership. However, both applicants and Notary & PPAT officers encountered
several obstacles or challenges during the conversion process for residential properties.
The conversion of land rights from Right to Build to Right of Ownership for residential houses in Nganjuk and Loceret Subdistricts of Nganjuk Regency has been conducted in accordance with the applicable requirements, procedures, and laws. To ensure the ongoing smooth implementation of this conversion process, land offices can provide guidance and counseling to the community, particularly to the residents of Nganjuk Regency.
