Efficiency and legal certainty in the export-import process in Indonesia
heavily depend on the reliability of the Indonesia National Single Window
(SINSW) system. A crucial aspect of this system is the mandatory submission
of business licensing electronically through SINSW, which functions to
simplify and integrate the export-import licensing processes across various
ministries and related agencies. However, issues remain concerning
suboptimal data integration, information security, and user understanding of
SINSW, which potentially lead to disputes over responsibilities between
exporters and importers. This study employs a normative approach by
analyzing regulations and best practices in international trade governance to
identify challenges and necessary solutions. The discussion focuses on two
main areas: strengthening SINSW through digitalization, enhanced data
security, real-time integration, as well as regular training and evaluation for
users; and the implementation of clear responsibility clauses in agreements
between exporters and importers, including dispute resolution mechanisms,
compliance guarantees, and sanctions for violations. The findings
demonstrate that synergy between government efforts to strengthen the
system and the enforcement of responsibility clauses in business agreements
can improve transparency, minimize the risk of disputes, and create a more
effective and regulation-compliant export-import environment. Therefore,
this integrated approach is essential for realizing efficient, secure, and
sustainable governance of export-import activities.
