Abstract

This study analyzes the effectiveness of administrative sanctions on motor vehicle
emission violations in Samarinda City, East Kalimantan. Using an empirical legal
method combined with a qualitative approach, data were collected through interviews
with environmental and transportation officials as well as motor vehicle users,
supported by relevant laws, regulations, and literature. The findings reveal that the
application of administrative sanctions is still largely preventive—such as the use of
stickers on vehicles failing emission tests—due to limited testing facilities and
personnel, the absence of specific local regulations, and low public awareness
regarding the importance of emission testing. Nevertheless, the proportion of vehicles
failing emission tests has decreased over recent years, indicating a gradual increase
in public awareness and compliance. This study recommends accelerating the
establishment of stronger local regulations, improving inter-agency coordination, and
intensifying public education programs to enhance the effectiveness of administrative
sanctions as an instrument for controlling air pollution in Samarinda City.
