The involvement of brokers in land acquisition transactions for housing investment
has become a common practice in Indonesia. However, most of it is done informally,
without a clear legal basis or written contract, thus giving rise to legal problems
such as price mark-ups, document forgery, and misleading information. This
problem is studied because it has the potential to harm investors and cause legal
uncertainty in the property sector. The unclear responsibility of brokers also
complicates legal protection efforts for the injured parties. This study aims to
examine the legal responsibility of brokers in land acquisition transactions for
housing investment based on positive legal provisions in Indonesia. The method
used is normatif legal research, with an approach to statutory regulations, legal
doctrine, which are analyzed deductively. The results of the study show that brokers
who do not have formal legality can still be held legally accountable if they commit
a breach of contract or an unlawful act. The legal responsibility of brokers can
include civil (breach of contract), criminal (fraud and document forgery), and
administrative (if they violate professional regulations) aspects. This study
emphasizes the need for a written agreement between investors and brokers, as well
as specific regulations regarding the land broker profession, including certification
and supervision. Thus, the formulation of the problem is answered through the
affirmation that brokers must comply with legal principles and are fully responsible
for their legal actions in land transactions.
