This research examines the dispute resolution between the coal mining company
PT. Kideco Jaya Agung and the local communities who claim land ownership within
the Special Mining Business Permit Area (WIUPK), which was initially designated
as forest area and later converted into Other Land Use (APL). The dispute arises
due to differing perceptions regarding land ownership following the change in land
status. PT. Kideco Jaya Agung relies on the Borrow-to-Use Forest Area Permit
(IPPKH) as the legal basis for land control, while the community believes they have
traditional ownership based on long-term use. This study employs empirical legal
research using a qualitative approach supported by primary and secondary data.
The results indicate that the dispute was resolved through negotiation, with
compensation provided to the community in the form of payment for existing crops
based on unit prices established by the local government. Despite the land status
change to APL, the compensation process and dispute resolution methods remained
consistent with previous practices that have become jurisprudence. This peaceful
settlement has proven effective in minimizing conflicts and ensuring the continuity
of mining operations.
