Abstract

This research was conducted with the aim of knowing about the Occupational
Safety and Health Implementation for Workers by Construction Service Providers
(Case Study in PT Formula Land). The research method used is to use a type of
empirical legal research that serves to be able to see the law in the real sense and
examine how the law works in the community. The data used in this study uses
primary data obtained directly during research in the field and secondary data
consisting of primary legal materials obtained from laws, official state documents,
literature relating to research, and legal journals, then secondary legal material
obtained from legal facts, doctrines, journals, research results, newspapers, the
internet, and scientific magazines, and tertiary legal materials obtained from
dictionaries.
The data obtained in this study were analyzed qualitatively to draw
conclusions obtained after research, that PT Formula Land as a construction
services company does not regulate specific provisions regarding Occupational
Safety and Health and does not have a special section or team that supervises
Occupational Safety and Health for workers as required by Article 7 Paragraph (2)
Government Regulation of the Republic of Indonesia Number 50 of 2012 concerning
Application of Occupational Safety and Health Management System. Supervision of
Occupational Safety and Health for workers at PT Formula Land is only carried out
within the scope of work accident and death guarantees only. In the study it was
found that PT Formula Land did not provide pension insurance and pension benefits
to its workers as written in the provisions of Article 6 paragraph (2 ) Law Number 24
of 2011 concerning the Social Security Organizing Body.
