Free legal aid is one of the most important duty of the Advocates. Clause
56 of Procedure of Criminal Law Code claim that every Advocates must give the
free legal aid for those who are poor. The duty to give the free legal aid based on
the Equality Before the Law Principal. This duty regulated in clause 22
paragraph (1) of statue no.18/2003 about Advocates that said “Advocates must
give the free legal aid for those who poor which searching for the Justice. From
the above background, it is in the writing of this essay presented two main issues,
namely : how the role of Advocates in providing the giving of free legal aid upon
the occurrence of Statue No. 16/2011 ?and what is the detention in the
implementation of giving the free legal aid for those who are poor?. This research
is normative research, made by reviewing/analyzing secondary data in the form of
legal materials, especially primary legal materials and secondary legal materials
to understand the law as a set of rules or norms in the system of positive law
governing the human life. The conclusion of the research indicate that the
detention in the implementation of giving the free legal aid which hindered by the
rule of the government No 42/2013 and Statue No 16/2011.
