Abstract

The handling of sexual violence cases in Indonesia remains inadequate,
particularly those involving child victims with disabilities. Police often
misunderstand accessibility as stipulated in the law, resulting in investigations
being stalled due to lack of evidence and victims' statements being deemed
inadequate. Despite the existence of the Sexual Violence Crime Law, the Law on
Persons with Disabilities, Government Regulations on Adequate Accommodation
for Persons with Disabilities, and advocacy organizations for persons with
disabilities, police compliance with and provision of accessibility remains
inadequate, particularly in Yogyakarta. Research based on interviews with the
Women and Children Protection Unit (PPA) and the Indonesian Child Protection
Agency (SIGAB) revealed obstacles such as the lack of specific SOP for handling disabilities and limited facilities and infrastructure. The Constitution of the Republic of Indonesia guarantees everyone the right to equality and equity, including for persons with disabilities, and this is further reinforced by several other regulations. The police must provide special training for investigators with disabilities and develop specific SOP for handling crimes involving victims with disabilities to foster inclusive investigations.
