Technological developments have given rise to various innovations, one of which
is crypto assets. Crypto is a digital financial asset that can be traded or invested in.
In Indonesia, the rapid development of crypto as a digital asset has led to a shift in
regulatory and supervisory authority from the Commodity Futures Trading
Supervisory Agency (BAPEBBTI) to the Financial Services Authority (OJK)
through the PPSK Law. This study aims to analyze the legal consequences of this
shift in authority, through Financial Services Authority Regulation Number 27 of
2024 concerning the Implementation of Digital Financial Asset Trading, including
Crypto, regarding the criteria for crypto assets that can be traded by crypto
investors. The method used in this study is normative juridical research through a
literature review. The results show that the OJK has tightened the criteria for crypto
assets and added crypto assets to the list of tradable assets to protect consumers
and investors from losses without reducing their freedom to choose assets for
investment. Consequently, there has been an increase in trading and the number of
crypto investors in Indonesia since the transition. This change routinely removes
the list of crypto assets that are unhealthy or lack strong fundamentals, but it also
makes it difficult for investors to understand the changes in regulations and the
applicable crypto asset list.
