Abstract

The Constitutional Court Decision Number 168/PUU-XXI/2023 marks an
important development in Indonesian labor law, particularly concerning sectoral
wage regulation. The decision reinstated the Sectoral Minimum Wage by correcting
its abolition under Law Number 11 of 2020 on Job Creation, which was considered
inconsistent with social justice principles and workers’ constitutional rights. This
study aims to examine the regulation and implementation of sectoral wages
following the Constitutional Court decision. This research employs a normative
legal method using statutory, conceptual, and case approaches, with qualitative
analysis based on deductive reasoning. The findings reveal that the post-decision
wage regulation does not introduce a new system but restores the UMS framework
as regulated under Law Number 13 of 2003 on Manpower, further strengthened by
Minister of Manpower Regulation Number 16 of 2024 and Government Regulation
Number 49 of 2025. However, its implementation faces challenges, including
limited sectoral data, weak institutional capacity, inadequate labor supervision,
and ineffective enforcement. Strengthening regulatory frameworks, institutional
capacity, and law enforcement is therefore essential to ensure wage justice and
legal certainty for sectoral workers.
