Abstract

This research examines the legal protection of children who are victims of sexual
violence through a comparative study of Indonesian and Malaysian law, aiming to
assess the adequacy of existing legal frameworks and identify effective practices for
improving child protection. Employing a normative method with statutory and
comparative approaches, the research analyzes relevant legislation, institutional
arrangements, and child-friendly procedures in both countries. The findings indicate
that Indonesia has established a relatively comprehensive regulatory framework for
child protection; however, challenges remain in its implementation, particularly in
terms of limited resources, weak inter-agency coordination, and social stigma that
restrict reporting and access to services. In contrast, Malaysia demonstrates more
integrated and procedural mechanisms, including specialized legislation and
coordinated multi-sectoral responses that better support child victims and minimize
revictimization. The study concludes that strengthening institutional coordination,
expanding integrated services, and adopting child-sensitive legal procedures are
essential steps to enhance the effectiveness of child protection in Indonesia.
