Illegal gold mining (Pertambangan Emas Tanpa Izin / PETI) in Kapuas
Hulu Regency has become a continuing problem that contributes to environmental
degradation and challenges in law enforcement. This study aims to examine the
implementation of law enforcement against PETI and to identify the factors
influencing its effectiveness. The research applies an empirical legal method by
collecting primary data through interviews with law enforcement officers and the
Environmental Agency, supported by relevant laws and literature.
The findings indicate that law enforcement efforts have been conducted
through operations, installation of police lines, and legal actions against offenders.
The Environmental Agency also plays an important role in supervising
environmental impacts, particularly water pollution and land damage caused by
mining activities. However, these efforts have not been fully effective, as illegal
mining activities often resume after enforcement actions, indicating a limited
deterrent effect.
The effectiveness of law enforcement is influenced by several factors,
including geographical conditions, limited resources of law enforcement agencies,
and low public legal awareness. In addition, the continued use of mercury reflects
weak environmental supervision. Although clear legal regulations and institutional
commitment exist, stronger coordination among institutions and greater public
awareness are required to improve the effectiveness of law enforcement.
