Abstract

This research is titled "Consumer Protection Against Exoneration Clauses in Standard Agreements for Goods Delivery Services at J&T Express." The rapid advancement of technology and e-commerce services has increased the reliance of Indonesian society on logistics services, which frequently utilize standard agreements in their operations. The primary issue in this research is the imbalance
of bargaining power between business actors and consumers, where J&T Express includes exoneration clauses that limit or waive liability for lost or damaged
shipments. This is exemplified by a case in Ketapang Regency, where a consumer
suffered a loss of IDR 10,600,000 but was only offered IDR 300,000 in
compensation. The problem formulations in this study cover the legal consequences
of including such exoneration clauses and whether their application complies with
the prevailing laws in Indonesia. This study employs a normative legal research
method with a qualitative analysis approach and deductive conclusion drawing.
The data sources include primary legal materials such as Law Number 8 of 1999
concerning Consumer Protection (UUPK) and the Indonesian Civil Code (KUH
Perdata). The results of the study indicate that the inclusion of exoneration clauses
which unilaterally transfer the responsibility of business actors potentially violates
Article 18 of the UUPK. According to Article 18, paragraph (3) of the UUPK, any
prohibited standard clause is declared null and void (batal demi hukum), meaning
business actors remain obligated to provide appropriate compensation. This
research concludes that there is a disharmony between field practices and consumer
protection regulations, necessitating further legal certainty to guarantee
consumers' rights to security and fair compensation.
