Plasma partnership in oil palm plantations is a form of cooperation between plantation
companies and local communities aimed at improving community welfare. In practice, the
implementation of plasma partnership agreements often results in legal issues in the form
of breach of contract. This research aims to analyze the forms of breach of contract
committed by PT. BKP in its plasma partnership agreement with the community of Nyari
Village and the available dispute resolution efforts.
This study employs a normative legal research method using statutory and conceptual
approaches, supported by primary data obtained through interviews. The findings indicate
that PT. BKP committed breaches of contract in the form of delayed profit distribution,
lack of transparency in financial reporting, and weak supervision over the cooperative
responsible for implementation. Dispute resolution may be pursued through non-litigation
mechanisms such as deliberation and mediation, with litigation as a last resort.
