Children are valuable national assets whose rights must be protected, including
when they come into conflict with the law. Indonesia has enacted Law Number 11
of 2012 on the Juvenile Criminal Justice System, which emphasizes restorative
justice and diversion as alternatives to formal criminal proceedings. This study
aims to analyze the law enforcement process against children who commit criminal
offenses in Sleman Regency based on the implementation of Law Number 11 of
2012. This research employs a normative legal method, supported by empirical data
obtained through interviews with law enforcement officers, including the police,
prosecutors, and judges in Sleman. The findings indicate that diversion has been
formally implemented at every stage of the juvenile justice process; however, its
effectiveness is often constrained by limited understanding among law enforcement
officers, inadequate supporting facilities, and resistance from victims and the community who still adhere to retributive justice. Despite these challenges, the principle of the best interest of the child remains the primary consideration in handling juvenile criminal cases. Therefore, strengthening institutional capacity,
improving public awareness, and enhancing inter-agency coordination are essential to optimize the application of restorative justice and diversion in juvenile criminal cases.
