Abstract

Corruption is a crime that significantly harms state finances and weakens public trust in
law enforcement. In the prosecution process, the preparation of an indictment in
corruption cases plays a crucial role in determining the success of criminal sentencing,
and therefore must comply with both formal and material requirements and be fully based
on the results of the investigation. Based on interviews with Public Prosecutors, the
selection of the indictment type single, subsidiary, alternative, or cumulative is
determined by the prosecutor’s accuracy in examining facts, evidence, and the relevance
of the applicable provisions. The strength of an indictment is strongly influenced by the
sufficiency of at least two pieces of evidence, prompting prosecutors to use an element
matrix to ensure that each element of the statutory provisions is supported by relevant
facts. Challenges such as case complexity are addressed through internal exposés,
consultations, and technical guidelines issued by the Attorney General’s Office.
Generally, indictment failure is rare and usually results from differences in legal
interpretation between prosecutors and judges. Quality of an indictment is a key factor
in the success of evidentiary proceedings and the overall effectiveness of corruption eradication efforts.
