Criminal acts of abuse cause physical, psychological, and social suffering for
victims, but the fulfillment of victims' rights in the Indonesian criminal justice
system is still not optimal, including in cases involving child perpetrators, which
tend to focus on the handling of the perpetrators. Diversion with a restorative
justice approach is expected to provide more victim-centered recovery as stipulated
in Law Number 11 of 2012, although its implementation at the investigation level
still faces a number of obstacles. This study uses empirical legal methods through
interviews with victims, investigators from the PPA Unit, and mediators from the
Bantul Regency PPA Technical Implementation Unit, then analyzed qualitatively
with the support of primary and secondary legal materials. The results of the study
show that diversion has accommodated victim protection, assistance, restitution,
and social relationship restoration, but its implementation has not been optimal due to the limited understanding of officials regarding the concept of restorative justice,
the lack of psychological assistance, and the low participation and awareness of
victims regarding their rights. This study concludes that diversion has the potential to fulfill victims' rights if it is implemented in accordance with regulations, actively
involves victims, and is accompanied by adequate support from officials and accompanying institutions.
