The Indonesian criminal justice system is governed by the Criminal Procedure
Code (Kitab Undang-Undang Hukum Acara Pidana) as the formal legal framework
regulating criminal proceedings and evidentiary processes. Prior to the enactment
of the new Criminal Procedure Code, electronic evidence was not explicitly
regulated under the previous KUHAP, resulting in legal uncertainty and reliance
on sectoral legislation, particularly the Law on Electronic Information and
Transactions. The enactment of the new Criminal Procedure Code under Law
Number 20 of 2025 constitutes a fundamental reform by expressly recognizing
electronic evidence as a lawful means of proof and integrating it into the national
criminal evidentiary system. This study aims to analyze the legal position and
evidentiary strength of electronic evidence within the Indonesian criminal justice
system following the enactment of the new KUHAP. Using normative legal research
methods through statutory and doctrinal analysis, this research finds that electronic evidence holds an equal legal position with other forms of evidence and is assessed under the principle of negative statutory proof, requiring lawful acquisition, relevance, corroboration with other valid evidence, and judicial conviction, while simultaneously reinforcing the role of the KUHAP as lex generalis and positioning the Law on Electronic Information and Transactions as lex specialis, thereby enhancing legal certainty and effectiveness of criminal law enforcement in the digital era.
