Abstract

This research is motivated by the emergence of a polemic concerning female leadership as a
raja (traditional leader) in Negeri Halong, Ambon City, which adheres to a patrilineal kinship
system where lineage and leadership rights are inherited through the male line. The research
question focuses on how the polemic arises and how it is resolved when a woman assumes the
position of raja within this system. The purpose of this study is to analyze the compatibility
between customary law norms and positive law, as well as to identify forms of resolution that
harmonize local tradition with the principle of gender equality. This study employs a normative
legal approach, using primary data from statutory regulations and regional laws related to
customary governance, and secondary data obtained through literature studies and interviews
with the Raja of Negeri Halong and the Saniri Negeri. The results show that the appointment
of a female raja remains valid under the customary law of Negeri Halong as long as she
originates from the matarumah parentah and is approved by the Saniri Negeri. From the
perspective of positive law, this appointment aligns with the principles of equality set forth in
the 1945 Constitution and Ambon City Regional Regulations No. 8, 9, and 10 of 2017. In
conclusion, female leadership in Negeri Halong reflects a harmonization between customary
law and national law that is adaptive to social change.
