This legal memorandum examines the legal remedies available to Alif Siregar and the community
of Kelurahan Amplas regarding the alleged pollution of the Deli River caused by the rubber
production activities of PT. Asahan Pabrik Karet (PT. APK). The pollution has resulted in foul
odors, damage to vegetation along the riverbank, and a decline in the quality of the surrounding
environment. Through an analysis of various legal instruments—including the 1945 Constitution
of the Republic of Indonesia, the Indonesian Civil Code, Law Number 32 of 2009 on Environmental
Protection and Management, and relevant implementing regulations—this memorandum affirms
that affected residents have the right to file claims for compensation through both litigation and
non-litigation mechanisms. These rights are supported by the principle of strict liability, the
constitutional right to a good and healthy environment, and the availability of class action
procedures. The analysis concludes that legal action may be pursued due to ecological, social,
and health-related losses suffered by the community as a result of industrial activities. The
memorandum recommends prioritizing non-litigation dispute resolution as a more efficient and
cost-effective approach, offering greater potential for reaching a comprehensive environmental
recovery agreement before proceeding to court if necessary.
