The purpose of this study is to examine the legal relationships and responsibilities
of the parties in the KSO-funded Willie Stadium renovation project. Despite the
completion of construction work and the use of the facility by the Massachusetts
County Government, PT AKT failed to fulfill its obligations to CV AK as the
implementing contractor. This study employs a normative-legal method, drawing
on a conceptual and legislative approach, as well as primary and secondary legal
materials. The results of the study indicate that only PT AKT and CV AK have a
binding legal relationship based on a valid construction services contract under
Article 1320 of the Civil Code. PT AKT has no direct contractual relationship with
CV AK and, therefore, cannot bear civil liability for failure to fulfill payment
obligations. Failure to fulfill obligations by PT AKT creates a legal obligation in
the form of performance and/or compensation against CV AK. The corporate social
responsibility scheme does not relieve PT AKT of contractual liability as a debtor
under the agreement. Therefore, the only legal action that CV AK can take is to file
a lawsuit for breach of contract against PT AKT, while the MR County Government
can only act as a co-defendant to assess its actual participation in the project
