Abstract
This thesis discusses legal protection for electronic certificate holders in Indonesian land law.
The purpose of this study is to examine and analyze legal protection and obstacles faced by
holders of electronic land certificates in Indonesian land law. The research method used in this
study is normative juridical, while the research specification used is descriptive analytical. The
source of information in this study is secondary data obtained through a literature review. The
data collection techniques used in this study are document study and literature study, while the
data analysis method uses qualitative descriptive data analysis. The results of this study
indicate that legal protection for holders of electronic land certificates does not pose a problem,
as these certificates are recognized as valid electronic proof of ownership under the Electronic
Information and Transaction Law (EIT Law), specifically regulated in Article 6. Its validity is
also unquestionable, especially after being reinforced in Article 5 of the Regulation of the
Minister of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) Number
1 of 2021. The obstacles faced in welcoming the electronic land certificate program are the
absence of a valid database on land maps throughout Indonesia, which makes it difficult to
realize electronic certificates, population data in Indonesia is not yet organized and much of
the data is not updated, which does not guarantee the validity of land data, there is no
synchronization and harmonization of laws and regulations to support electronic land
certificates, efforts to socialize electronic certificates to various parties are not yet optimal,
and digital facilities and infrastructure are still uneven and inadequate throughout Indonesia,
making it difficult to implement.
