Abstract
Corruption is an extraordinary crime that causes significant losses to state finances
and undermines the principles of law enforcement. Problems arise when corruption
is committed by members of the Indonesian National Armed Forces (Tentara
Nasional Indonesia/TNI), due to differences in the regulation of jurisdiction
between the Military Court and the General Court. Law Number 31 of 1997 on
Military Courts determines jurisdiction based on the status of the perpetrator, while
legislation on corruption eradication affirms that corruption falls under the
jurisdiction of the Corruption Court within the General Court system. This study
aims to analyze the authority of the Military Court and the General Court in
handling corruption offenses committed by TNI personnel, as well as the legal
implications arising from overlapping jurisdictions. The research method employed
is normative legal research using a statutory approach. The results indicate
inconsistencies in legal norms that create legal uncertainty and potentially violate
the principle of equality before the law. Therefore, harmonization and reform of
legislation are necessary to ensure legal certainty and justice in the handling of
corruption offenses committed by TNI personnel.
