Abstract
The use of noisy exhaust pipes in the city of Yogyakarta is a serious legal and
environmental problem because it violates traffic regulations and causes noise
pollution that disturbs public order, comfort, and health. Although there are various
regulations governing noise thresholds, such as Minister of Environment
Regulation No. 56 of 2019 concerning Noise Thresholds for Motor Vehicles,
violations of these provisions remain rampant. Therefore, this study aims to
determine how sanctions are applied to the use of noisy exhaust pipes as a measure
to prevent noise pollution in Yogyakarta City. This study uses an empirical legal
research method. The results show that the application of administrative sanctions
against the use of noisy exhaust pipes in Yogyakarta City has been effective. The
Yogyakarta Police have implemented various forms of sanctions, such as written
warnings, tickets, confiscation, and orders to replace the exhaust pipes with
standard ones, which have proven to have a deterrent effect on violators and reduce
the level of violations in the Yogyakarta City area. The effectiveness of these
sanctions is also supported by increased public legal awareness, good coordination
between the Yogyakarta Police and the Environmental Agency, and more intensive
legal outreach. Thus, the application of administrative sanctions has been effective
as an instrument of environmental law enforcement because it plays an important
preventive and repressive role in combating noise pollution and maintaining traffic
order as the community's right to a good and healthy environment as mandated in
Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia.
