Abstract
This research discusses the consistency of law enforcement against theft of
plantation products in Indonesia with a focus on Case Study Decision Number
59/Pid.C/2023/PN Bls. The background of this research is the rampant cases of
theft of plantation products that affect the economic sector and discrepancies in
the application of applicable laws. This study found that in practice, law
enforcement officials often use general articles in the Criminal Code (KUHP),
such as Article 364 on petty theft, to ensnare perpetrators of theft of plantation
products, even though there is a special regulation in Law Number 39 of 2014
concerning Plantations. This inconsistency is considered to ignore the principle
of lex specialis derogat legi generali, where special rules should override general
rules. In addition, the judge's consideration in handing down the verdict also
included juridical and non-juridical aspects, taking into account the legal facts
at trial and the condition of the defendant. This research recommends the need
for further socialization of the Plantation Law and increased legal awareness
among law enforcement officials to realize legal certainty and justice in similar
cases.
