Abstract

This research aims to analyze China’s implementation of human rights obligations
in ensuring access to remedy for victims of human rights violations in the business
sector, with a study case of the SHEIN provider company in Guangzhou. The
problem discussed in this thesis is the form of State responsibility to provide access
to remedy according to the United Nations Guiding Principles on Business and
Human Rights framework, as well as the extent to which the state fulfills these
obligations in the domestic legal context. This study applies the normative juridical
method with a legislative and case study approach. The data was obtained through
document research and analyzed qualitatively. The research findings indicate that
although China has a set of good labour law system normatively, its implementation
in the SHEIN case does not guarantee an effective remedy. The State has not fully
provided a safe and transparent complaint system for workers who are victims of
human rights violations. Investigative reports reveal that many workers in SHEIN’s
Supplier factories in Guangzhou worked excessively long hours, lacked formal
employment contracts, and were paid based on the number of garments produced,
which significantly reduced their ability to access legal remedies or prove labor
rights violations. These findings indicate a discrepancy between the State official
obligations and the actual realization of victims’ stat rights. It is concluded that
China needs to strengthen its remedy mechanisms by ensuring legal aid,
establishing an independent grievance mechanism, and providing financial
support to vulnerable workers seeking justice. Enhanced legal enforcement and
meaningful corporate accountability are also necessary to accommodate broader access to effective remedy in line with the United Nations Guiding Principles on Business and Human Rights.
