This study analyzes the implications of the sale and purchase agreement of
an iPhone branded mobile phone telecommunications device whose International
Mobile Equipment Identity or IMEI is not registered. Based on the laws and
regulations in Indonesia, IMEI registration is mandatory for all mobile phone
telecommunications devices. By not registering the IMEI, it has violated the laws
and regulations which can result in blocking access to the mobile cellular network.
This study uses a juridical-normative approach by examining related laws and
regulations, such as the Civil Code, Regulations of the Director General of Customs
and Excise and the Ministry of Communication and Information concerning IMEI control. The conclusion obtained from the results of the study shows that the sale and purchase agreement whose object of sale and purchase is an iPhone branded mobile phone whose IMEI is not registered is null and void. This is because the agreement does not meet the objective requirements for the validity of an agreement
based on Article 1320 of the Civil Code, namely the requirement of "lawful cause" because the object of sale and purchase violates the laws and regulations that regulate it.
