This thesis discusses the application of Article 480 paragraph (1) of the Criminal
Code to the object of fiduciary collateral in the Decision of the Sukoharjo District
Court Number 136/Pid.B/2024/PN.Skh. The defendant Sutimin was charged with
committing the crime of receiving a car that was still the object of fiduciary
collateral through PT. Astra Credit Companies (ACC). The car was purchased by
Joko Widodo and entrusted to the defendant because there was no parking space
at his house, the defendant is a close relative who has a car rental business, then
the car was rented with Joko Widodo's permission but the defendant did not know
that the car was still on credit and became the object of fiduciary collateral. The
research method for this thesis uses a normative approach with data collection
techniques through document studies and interviews. The purpose of this thesis
research is to analyze the judge's legal considerations in deciding the case and freeing the defense from receiving the indictment. The results of this thesis research show that the judge considered that it did not fulfill the element of intent because the honesty did not know the legal status of the car as a fiduciary guarantee and there was no intention to control the car so that the judge decided to be free in the decision.
