This research was conducted to find out the operationalization of The Health Law No. 23, 1992 as an Administrative Penal Code in overcoming the crime of carrying out pharmaceutical work without having any expertise and authority as carried out by health personnel in the district of Sleman State Court. This research used normative method. The result showed that the law court sentenced four months prison to the accused.
Such a court sentence, although lower than the prosecution of the public prosecutor, was effective both as guidance and control for the society and as general prevention. As a guidance and control for the society, this court sentence gives useful information that the one who is responsible for carrying out the pharmaceutical work is pharmacist. As a general prevention it is effecive to prevent the society in general from being influenced by the offender and not to act such an offense in their lives in the future.
