This study examines the control of river pollution caused by PT Sumber Energi Jaya
(SEJ) in Motoling Timur District, focusing on the roles of the Environmental Agency
(DLH), sub-district authorities, the company, and local communities. Findings reveal
significant discrepancies between institutional claims and field realities. Although
DLH reports regular monitoring in line with Law No. 32 of 2009, no administrative
sanctions have been enforced despite signs of environmental non-compliance.
Community complaints noted by the sub-district government lack formal reporting,
indicating weak coordination. The company claims to use a closed-loop wastewater
system but provides no evidence of routine water quality testing. Furthermore, the
absence of public disclosure of the Environmental Impact Assessment (AMDAL) and
limited community involvement violate legal provisions on transparency and
participation, as outlined in Articles 26 and 70 of the Environmental Law and Article
96C of the Mining Law. These issues underscore fragmented environmental
governance, low public engagement, and weak legal enforcement, which together pose
long-term ecological risks and threaten the constitutional right to a clean and healthy
environment.
