This research is based on problem related issues to self-protection as
adefense against assault or threats of attack accompanied by analyzing the judge’s
considerations in forced defense. Which aims to find out whether the act leads to
forced defense or criminal act. The method used in writing this law is normative
legal research method accompanied by a case approach. And the results of this
study, after analyzing thatt defendant’s actions as in Decision Number :
373/Pid/PN.Pdg were not forced defense because one of the elements or conditions
was not met, there was no balancing between attack and defense by the defendant,
and that is cannot be declared as a forced defense.
