This study aims to analyze the binding force of a sale and purchase agreement
(PPJB). This study was conducted to examine whether a sale and purchase
agreement (PPJB) can be used as a basis for changing the name of land ownership
if the seller has died and the participation of the seller's heirs in the process of
changing the name of the sale and purchase deed. This study also aims to examine
the legal consequences that can arise if there is legal smuggling in the making of a
sale and purchase agreement (PPJB). The method used in this study is to use a
qualitative research method with data obtained based on interviews with notaries
and lawyers in the city of Magelang who handle problems regarding sale and
purchase agreements (PPJB). The reasoning method of this study is the deductive
reasoning method. The results of the study show that the seller can change the name
on the basis of a paid sale and purchase agreement (PPJB) by asking for assistance
in the form of administrative data from the seller's heirs. Analysis of the sale and
purchase agreement used as legal smuggling can be canceled because it contains a
flawed will and is an unlawful act. The conclusion of this study is that the sale and
purchase agreement (PPJB) can be transferred to another name even if the seller
has died and this sale and purchase agreement can be cancelled if it is proven to be
an unlawful act.
