Abstract
The advancement of technology in the military domain has led to the replacement
of analog systems with more modern alternatives, particularly in warfare involving
swarm drones. The integration of artificial intelligence to control these swarm
drones, coupled with the potential to equip them with high-destructive weaponry,
raises concerns regarding potential violations of human rights, especially
concerning civilians. This research aims to analyze the legality of using swarm
drones in the armed conflict between Russia and Ukraine from the perspective of
international humanitarian law. This study employs a normative legal research
method, primarily drawing upon the 1907 Hague Conventions, the 1949 Geneva
Conventions, and the 1977 Additional Protocols. The findings indicate that the use
of swarm drones that are unable to distinguish between civilians and combatants,
and are capable of causing excessive damage, constitutes a violation of the
principles of international humanitarian law.
