The title of the legal research is inheritance according to BW for members of the
Society of Jesus (SJ). Every human past 3 important moments, a human comes into the world by
birth, when a human being is married and a human gonna die. In the third life cycle, legal
consequences arise such as the status of ownership of objects previously owned by the legal
subject while they were still alive. Ownership of property after a human dies is transferred to
another person, then a law called inheritance is formed. The application of the inheritance law
system according to BW cannot be automatically applied to a catholic religion, in this case, a
member of the Society of Jesus (SJ). This study uses a normative method. This research explains
that Pastors of the Order of the Jesus Union (SJ) have rights protected by the Civil Code, namely
the right to receive an inheritance or refuse an inheritance with a mechanism that has been
regulated by laws and regulations. The conclusion of this study is the inheritance refusal
mechanism is not in accordance with the statutory regulation mechanism. Suggestions from this
research suggest that the leadership of the Order of the Society of Jesus (SJ) replace the
inheritance refusal mechanism according to the mechanism determined by law, and suggest that
family members of the Order of the Society of Jesus (SJ) be involved to know that every Pastor is
a member of the Society of Jesus ( SJ) is not allowed to receive an inheritance.The title of the legal
research is the BW inheritance for Society of Jesus’ priests. Every people in their life pass three
essential phases, those are birth, married, and died. At the third phase, people have special law
(akibat hukum), mainly property ownership of their things that they had during their life. When
people died, their property ownership will be passed to others which is called as as inheritance
law. The application of inheritance law system according to BW cannot be automatically applied
to catholic clergy, specifically Society of Jesus’ priests. The inheritance law cannot be applied
because the Society of Jesus’ priests are bound to the Society of Jesus’ Constitution which states
that the Society of Jesus’ priests cannot receive inheritance. The research employs normative
method. The research explains that the Society of Jesus’ priests have rights protected by BW, that
is rights to receive inheritance or to refuse inheritance with a mechanism that has been regulated
by laws and regulations. The result of the research is inheritance refusal mechanism does not in
line with law mechanism. The research suggests to the Society of Jesus’ leader to change the
inheritance refusal mechanism with the mechanism based on constitution and suggests to involve
the family of Society of Jesus’ priests to know that Society of Jesus’ priests cannot receive
inheritance.
