Abstract
Murder is one of the criminal acts regulated in Articles 338, 339, and 340 of the
Criminal Code (KUHP). Article 340 of the Criminal Code (KUHP) clearly explains
premeditated murder. This study aims to examine the accountability of the
perpetrators of premeditated murder against the wrong victims. The method in this
study uses normative legal research, with a legal analysis method. The result of the
research and analysis is that the perpetrator is still sentenced in accordance with
Article 340 of the Criminal Code (KUHP) with the existence of elements of murder
as the basis for the judge's consideration to provide criminal responsibility for the
perpetrator.
