Land is a very important resource for human survival, especially people in
geographical terms in Indonesia, its function is strategic because it involves the lives
of many people. In accordance with the provisions of Article 33 paragraph (3) of the
1945 Constitution of the State of Indonesia, it is outlined in a special regulation. The
regulation is Law No. 2 of 1960 concerning Basic Agrarian Principles. This law
contains land law that applies in Indonesia. Article 2 reads ‘the earth, water and
airspace, including the natural resources contained therein, are at the highest level
controlled by the State, as the organisation of the power of all the people’. The State
in its control is authorised to: ‘regulate and organise the allocation, use, supply and
maintenance of the earth, water and airspace, determine and regulate legal
relationships between people and the earth, water and airspace, and determine and
regulate legal relationships between people and legal acts concerning the earth, water
and airspace’. Basic Agrarian Law No. 5/1960 in Article 2 and Article 18 explains
about: Basic Agrarian Law Number 5 of 1960. Based on the description of the
background of the problem above, the author is interested in conducting research for
Legal Writing / Thesis on ‘Implementation of Compensation in the Construction of
Semarang-Batang Toll Road Section Two in Gringsing Village.’
