Police role and actions related to the misuse of illegal firearms by civilians,
triggering police performance in dealing with higher firearm ownership. Number of
misuse of firearms and easy to get guns from the black market, creating a sense of
insecurity in society, because the number of illegal possession of firearms made for
criminal acts. State of Indonesia, including the State normatively actually quite strict in
applying the ownership of firearms for civilians. There are a number of basic laws that
regulate on this matter, ranging from the Law No. 8 of 1948 on Registration and Granting
Permit Firearms, Emergency Law No. 12 of 1951 on Firearms Regulation No. 20 of 1960,
and Law No. 28 of 1997. The problem of this research is "whether the police action taken
against illegal misuse of firearms by civilians and what constraints faced by the police in
uncovering or tackle illegal circulation of firearms". The purpose of this study is to
investigate the role and actions of the Police and find out how the legal process against
civilians who have illegal firearms. This type of research used in this research is
normative legal research, ie research that focuses on the norms of law to require other
data as supporting the main data, which includes interviews with sources. Writing this has
some conclusions, namely the purpose and arrangement of firearms, the things that cause
civilian use of illegal firearms and the factors, the preventive and repressive police action
against the misuse of firearms. The author also has a suggestion of this writing, namely:
the role of the community to be more active in providing information about the circulation
of illegal firearms, the establishment of a special agency that handles the circulation of
illegal firearms in the territory of the Republic of Indonesia, and also tighten the border
region of the Republic of Indonesia which is suspected as the entry of illegal firearms into
the territory of the Republic of Indonesia.
