The title of this Legal Writing / Thesis is The Civil Responsibility In
Tutoring Services Agreement On Failure Study of Educate Children (Case Study
Primagama Tutoring Institution). Nowadays high school students are trying to
register in the favorite state universities after they graduated from high school.
They try to achieve that purpose with take a course in the tutoring institutions.
Some tutoring institutions dare to give offers to the students. The offer is if the
students fail to pass the national selection entrance of state university, their money
will be refunded for one hundred percent but it is only if the students have
followed all the rules and suggestions from the tutoring institutions like to choose
what university and the faculty that the students should register. The existing
agreements must be adhered for both sides but with a note that the students must
follow all the rules that already applied by the tutoring institutions. The purpose of
this study is to determine how the obligations of the parties tutoring agencies as
parties to the agreement and to determine how the parties to civil liability. This
research was done by normative legal research. Normative legal research is a
research that focuses on positive legal norms and principles of law. The results of
this study is that the tutoring institution has performed his duty with pretty well
and so did the students. The author suggests that it would be more saver
agreement if it was a written agreement and the tutoring institutions should make
a black in white agreement or in other words the agreement must be written
agreement.
