Freedom of thought and expression in accordance with conscience and the right to
obtain information, was the most real human rights. This right is then supported
by the advancement in information technology which provides various facilities to
access information and communicate, one of the most widely used by the public is
electronic mail. In sending information through the electronic mail, someone
might not use his freedom in stating thoughts and opinions in a manner was
unlimited because still had the rules that must be obeyed. This freedom is often
misused because people think that there are no rules governing the transmission of
information in electronic mail. The abuse of that freedom may design a
defamation which is included in the act on variants against the law. Therefore, a
person who has been convicted do an offence against the law, requires that person
compensate for errors that were instituted. This case is still warm cases are

Sutera. Purpose of this legal research is to investigate and find out the benchmarks
used by the judge to qualify the presence or absence of illegal acts in the case of
contempt by electronic mail, to investigate and find out the considerations that are
used by judges in determining the amount of loss in case of contempt by
electronic mail. In this research the author uses the normative method is based on
literature study. From the results of research that has been done to get the author
considered the author made by qualified judges in action against the law and the
amount of compensation.
