The process of writing this thesis entitled PEMBERIAN HAK MILIK
ATAS TANAH YANG DIPEROLEH MELALUI PROGRAM REDISTRIBUSI
TANAH DALAM MEWUJUDKAN KEPASTIAN HUKUM BERDASARKAN
PERATURAN PEMERINTAH NOMOR 24 TAHUN 1997 DI DESA
PEMATANG DANAU, KECAMATAN MATARAMAN, KABUPATEN
BANJAR, PROVINSI KALIMANTAN SELATAN with the law issues whether
the receiver of the right of land through land redistribution program in Desa
Pematang Danau, Kecamatan Mataraman, Kabupaten Banjar, Provinsi
Kalimantan Selatan has already created the rule of law based on government
regulation number 24 by the year of 1997. The purpose of this research is to
know, to inspect, and to analyze whether the receiver of the right of land through
redistribution program in Desa Pematang Danau, Kecamatan Mataraman,
Kabupaten Banjar, Provinsi Kalimantan Selatan has already created the rule of
law based on government regulation number 24 by the year of 1997. The type of
this research is empirical law research that is held directly toward the
respondents and informants. This research is analytical descriptive which
describe what are stated by the respondents and informants in a whole. Based on
the result of the research in Desa Pematang Danau, Kecamatan Mataraman, the
farmers who receive the right of land through the program of redistribution of
land has already list their right on the land and receive the certificate of the right
of land from land affairs office in district of Banjar. Since, the certificate of the
right of land is obtained by 2005, there is no accusation from the third party so
that it has already created the rule of law either juridicial data (law subject and
the status of land right) or physically data(expanse, location, and border of the
land). Based on the result of the research, it can be concluded that registration of
the right of land through redistribution program has already created the rule of
law for the receiver of the right of land based on the government regulation
number 24 by the year of 1997.
