In contempary society, there are many crimes, whereas the victims are emales,
either the crime of which is conducted physically or physicologically. Femalwe is a
weak human being that needs to be protected by males. In fact, there are a lot of
female victims of which the crimes are conducted by male. This matter has not been
ruled specifically by our criminal law. Meanwhile criminal law is a part of entire law
that is valid in a state, that establish the principles and rules determining which
actions is prohibited or disobeyed, with its threat or sanction by the shape of certain
punishment for those trespassed such prohibitions, determining when and in which
matter to those who trespass such regulations can be sentenced or punished criminally
appropriate with has been sanctioned, and determining how is the sentencing of
punishment can be conducted if there is a person that refused that he/she had
trespassed such regulation. However in criminal law, it doesn’t specifically rule on
the female’s right as the victim of criminal action. Thus, the author will study the
criminal law on the female’s right as the victim of criminal action, whether they had
been given legal protection or neither and also what berriers in providing legal
protection to the rights due of the victims of criminal action. In responding such
problems, the author used normative/literary research and also conducted interview to
two source persons that have often overwhelm the case on criminal action whose
victims are female. After the research was conducted, the author concluded that in
generally, criminal law has given legal protection to the female. However it didn’t
protect specifically on the rights of female that become the victim of criminal action.
By the absency of specific regulation on female’s rights as the victim of criminal
action, thus it becomes the barriers in providing protection to female’s rights as the
victim of criminal action.
