The title of this legal research was Time-Based Lease Agreement of Tanker
Ship (Time Charter) (Case Study in PT. Bahtera Sama Rasa). The purpose of this
research was to know how the implementation of agreement and what are conditions
of time-based lease of tanker ship and how resolutions of conflict if one of these parts
violate. The type of research used was empirical juridical research of which focused

on the social behavior (law in action) and data sources of research were primary data
as main data and secondary data as supporting data. Method of data collecting used
was interview, i.e. asking and responding to the part of broker of ship leasing and
observing by direct observation to the documents of PT. Bahtera Sama Rasa. The
result of this research was leasing agreement i.e. a two way agreement between the
hired to the hirer of which is conducted in writing and appropriate to the valid
regulations, and if there is any difference or violation is decided by arbitrary
institution in London with English Law. The suggestion given was in order the
government and private can have their own tanker ship by the help of banking, and
hopefully the government in order to monitor the entry of foreign ships appropriate to
the SCWT of which has been ratified by government in order not to bring detriment
to both parts and also to ratify International convention on pollution in order not to
accept the compensation of detriment if they are suffering any pollution.
