Bullying often occurs in Indonesia. From old age to young, even children have
intentionally or unintentionally become perpetrators of child bullying or even
become victims of child bullying. The government has issued a Child Protection
Act as a legal certainty to protect children from bullying. Based on the research
conducted by the author, the author uses empirical legal research and quantitative
data analysis to find that Pati Regency has implemented legal certainty in the form
of the Child Protection Act, the Law on the Juvenile Criminal Justice System, and
Regional Regulation of Pati Regency and Regent's Regulation concerning
Implementation of Protection Against Gender-Based Violence and Children. The
implementation of legal certainty against child bullying in Pati Regency is in the
form of mediation (if child bullying cases do not go to court) and diversion
decisions by prioritizing Restorative Justice (if child bullying cases go to court).
The settlement of child bullying in Pati Regency has implemented legal certainty
for reported cases, but there are still many cases of child bullying that are not
reported because of the shame on the part of the victim, lack of knowledge about
the procedures for reporting child bullying, and lack of public sensitivity in the
event of child bullying. Based on this, it has not yet fully implemented legal
certainty for the resolution of child bullying in Pati Regency for unreported cases.
