Abstract
n a study entitled Regarding the liability of startup companies for the leakage of
consumer personal data, this study examines the extent of the liability of a startup
company if there is a leak of consumer personal data. This research is about the
protection of personal data in the contract between startups and consumers
consists of two. First, regarding the existence of a standard agreement and the
second, the existing regulations. Violation of the standard contract is included in
default, while based on the existing laws and regulations it is an unlawful act. The
standard agreement between startup companies and consumers is called default
because the digital agreement has the potential to harm consumers because the
agreement is prepared, made, used unilaterally by startup companies. This
research uses a normative methodology that is based on laws and regulations and
doctrines from experts. The result is that regulations regarding the protection of
consumer personal data already exist, but in fact these regulations are not
implemented properly due to the lack of clarity on the contents of these
regulations. We need proper regulations regarding this issue, especially the
responsibility for startup companies regarding standard agreements made by
consumers and startups.
