Rape is a horizontal crime that often occurs in Indonesia. Rape has a wide
impact on social and cultural aspects. The Criminal Code regulates rape as a
crime punishable by imprisonment. The Criminal Procedure Code as
procedural law in Indonesia also regulates the proof of the criminal act of rape.
Proof of the case uses witnesses as one of the valid evidence. The witness
referred to as evidence is a victim witness. Of the various types of victims, there
are types of victims who initiate the crime of rape. This paper aims to find out
how legal protection for victims of rape has a role in this crime. This writing
uses the normative juridical method with data sources from secondary data
consisting of primary legal materials in the form of statutory regulations, court
decisions, and secondary legal materials in the form of literature and research
results. The conclusion of this paper is that victims of the crime of rape who
have a role in the rape case still have the right to be protected in giving their
testimony.
