The institution of guarantee on the responsibility rights in general is used in banking field
especially governmental bank to guarantee the credit granting to the debtor, if the debtor
conduct the bad action thus the object of guarantee could be executed to get amortization.
The execution of guarantee of the debtor which conduct bad action by the governmental bank
should be submitted to the Committee of State Receivable Matters/Receivable Service Office
and State Auction (PUPN/KP2LN) based on the Law Number 49 Prp. of 1960 on the
Committee of State Receivable Matters. Then is becoming the problem formulation in this
legal writing were what factors pursuing the implementation of auction execution of
responsibility rights and also the efforts should be conducted by KP2LN Surabaya 2 in
overwhelming these barriers.
The conclusion of this legal writing was to answer the problem formulation, as follows:
1. The presence of debtor's suing to the State Court, thus the solution efforts which was
conducted by KP2LN Surabaya 2 was to delay the auction implementation or keep
continuing by asking the Statement Letter of KP2LN Surabaya 2.
2. Debtor refused to empty the object of guarantee voluntarily, thus the solution efforts
which were conducted by KP2LN Surabaya 2 to communicated debtor in order have
willingness to empty the object of responsibility right voluntarily of which will be auctioned.
3. The higher limit value of auction object compared with the market price, thus the solution
efforts which were conducted by KP2LN Surabaya 2 were to gave advice to the creditor to
communicate the debtor to decrease the values of this limit.
